Septic System Failing

septic system failing
What is my recourse if the person I bought my house was false disclosure?

In communication, the seller said no problem known in the septic system. Shortly after I moved in the neighbor told me the system had a backup and that the seller had estimates for a replacement. When the pumping system had confirmed that the system has failed. Unfortunately, we agreed to sign "as is" in our purchase agreement.

In most U.S. jurisdictions placing false information in disclosure is a violation of the Statute of Frauds, and makes the entire contract voidable. I'll both have two options – to sue for the cost of repairing the system, or suing for sale are canceled and your money back. (Do not worry about the fact that you signed the sales "As is" – which were induced to do so on the basis of fraudulent information document, so you will not be a problem.) In any case, you will want a lawyer (who's fees are recoverable), Richard

What can be done legally if you violate EPA laws?

I turned to my neighbors to take large amounts of trash on his property and not have a proper septic system. Since then I have been hauling trash out of your house for the truck and told another neighbor that they were given 10 days by the EPA cleaning. My question is, what kind of punishment by the law of the EPA can make available without cleaning.

In this case it would be fine. Small and huge fines. If neighbors have not been cleaned, the city / state / federal clean it for them and charge residents for the cost. If it was large enough, the government may seize the property. That's probably not going to happen here but, obviously, if they are not cleaned. In extreme cases, there could be jail time. But honestly, when something rises to that level is a corporation. CEO's have a fun way to avoid prison. So penalties, fines and more fines.

Can you be evicted if the landlord will not fix the septic tank?

My sister lives in the Pierce County, WA. and the owner given eight days to leave because they want to repair the septic system. The system has completely failed, the flow field as a whole must be replaced. This is an important health problem due to wastewater supported at home once and now can not run water or toilet use. PLEASE HELP ASAP! She has three children and can not afford to move.

It can. This is not an expulsion, but must move. It is in this sense that the foundation was bad. The repair is so high that is preferable to connect to the sewer line, if you can. Repairing the drainage area have a very long time, and perhaps not even possible if you put the code, simply can not own enough land. It will take months to repair, and can not even start with those living in the house. Why fight against it and insist on keeping their children in this state? Literally can not fix the septic field without much $ and many, many weeks Repair and cleaning of the environment.
